I have posted here only sporadically so as not to abuse this great privilege Lee has bestowed upon me. Manwhore, in this post below, shows complete ignorance about the Constitution and the confirmation process. I just had to respond.
Let me explain. John Roberts is acting like he is because he wants the job. Manwhore is right about that. He is dead wrong on everything else. Roberts is answering like he is because that is how every single nominee acted before him. It has been 11 years since the last confirmation hearing, so either Manwhore isn’t really old enough to remember the last one, or just simply knows nothing about the process. Nothing. Ruth Bader Ginsburg was so obstructionist, and yet so coddled, it was beyond belief. Breyer was just as bad. On the other hand, Clarence Thomas was right when he called what was done to him was a “high-tech lynching.” Roberts is, frankly, making the Democrats on the Senate Judiciary Committee his personal bitch. You think I am kidding? Go to this site and scroll down to A&C: Supreme Court Confirmation Hearings and watch for yourself how others acted at their hearings.
This is how the process works. The President nominates, and the Senate, by majority vote, confirms or rejects. No matter what the Democrats say, Bush has no obligation to get their advice or input. If he talks to them, it is out of courtesy, nothing more.
And, if Roberts promised Bush he’d overturn Roe v. Wade, and I guarantee you he did not, what could Bush do if Roberts failed to follow through? NOTHING! Because there is nothing he could do about it. There is only one way to remove a Supreme Court Justice, and that is by impeachment, which orignates in the House, not by the President. There has not even been an attempt to impeach a Supreme Court justice since Justice Chase in 1804. Because it could not be done.
And, Roberts can’t just walk in and overturn Roe. He’d need a real “case or controversy” that would gave him the opportunity. And even at that, he is only one vote. The Supreme Court CAN’T MAKE ANYTHING ILLEGAL. NOTHING!!! They are not a legislature, although they act as such often. They can’t in a decision say that ,"XXX is illegal henceforth.”
Right now, here’s the voting block that would never oveturn Roe: Kennedy, Souter, Stevens, Breyer, and Ginsburg. That’s the necessary five. Scalia and Thomas are the only two guarantees against it. And, Roberts as Chief Justice would likely never vote to overturn Roe because it would put that Court in a position that, historically, it tries its best to avoid being in. If Roe is the #1 issue, this confirmation, nor the one for O’Connor’s replacement, is not the real fight for the liberals. It’s when one of their reliable votes, like Ginsburg (who is in poor health) or Stevens, (who is 85) retires. All the hype you heard about this confirmation will be for real if one of those 2 retire.
And, why does Manwhore give a damn about Roe v. Wade anyway? You sound like one of those liberals I go to law school with who want to seem like they are all about women’s rights or some shit like this. The only reason NARAL, the ACLU, NOW, and those other left-wing wackos groups want to keep Roe v. Wade legal is because if they can’t scream that back-alley abortions, they CAN"T GET DONATIONS, i.e. GET PAID! Without that, they would have to get real jobs.
And, if Manwhore knew anything about this, he’d know the practical effect of overturning Roe is next to nil. The only states that would possibly criminalize abortion are South Dakota, Nebraska, Utah, and Lousiana. That’s it. Of course, the liberal groups would then have abortion buses leaving those states at every hour on the hour.
Roe v. Wade is a disgraceful decision not because it made abortion a Constitutional right, but because it was the boldest, most naked assertion of judicial power ever. The Court’s majority wanted to force a national policy on the country, and made abortion a Constitutional right when it is solely within the power of the states. Harry Blackmun, the disgrace fo a justice who wrote the decision, knew it was a crock of shit, as he spend the rest of his career and life trying to justify it. (Read this example of how much of a disgrace Blackmun was) When Blackmun was contemplating his vote in Roe, guess who influenced him most? His wife and daughter, not the Constitution. (Read this on that)
And, in one final act of outrageousness, Harry Blackmun decided one day that he was anti-death penalty. he announced in a denial of certiorari that, and these are his exact words: “From this day forward, I no longer shall tinker with the machinery of death.” Yeah, what balls from the same guy most responsible for millions of abortions.
Manwhore should stick to slick comments and quick hits, what does best. (And very well I might add). His Roberts post got me started because it was nothing different than one would see on a worthless, ill-informed left wing blog, and that post was not worthy of being posted here.
