Prosecuting Porno
by Lee

On the contentious subject of the fired US attorneys, Reason has a fascinating new tidbit.

Now comes word from two fired U.S. attorneys that they were dismissed primarily for refusing to take on the obscenity cases sent to them by the Justice Department.

This, to me, seems right in line with what we have come to expect from the administration.  Someone dares to disagree with their puritanical fundamentalist morality and, oops, they gots ta go.  The thing is, why the secrecy?  Why not just announce that they were getting rid of these guys for that reason?  I might not agree with it but it’s a perfectly legitimate reason for the president to fire a US attorney.  What do they have to hide?  Why all the cloak-and-dagger stuff to try and cover it up?

Something is rotten in Denmark.

Speaking of which, it looks like Gonzo is going bye-bye.

Lee,

Again I am going to tell you this:  You are dead wrong on this issue.

Let me give you an example.  The guy who got fired in New Mexico, David Iglesias, was an incompetent fuck.  Every high profile criminal case he either lost and/or goat-fucked, or did not prosecute because he was so risk averse.  Yet, he found plenty of time to prosecute bullshit crime like this:

SANTA FE, N.M., Aug. 18 (UPI)—A New Mexico federal jury wasn’t amused but still freed a woman of felony charges for sticking bubble gum and a note to her speeding ticket check.

It took the jury in Albuquerque two hours Wednesday to acquit Rosemary Ho, a 24-year-old dental hygiene student who was charged with two counts of mailing a threatening communication to the Motor Vehicle Division in Santa Fe in September 2003. If convicted, each count would have carried up to five years in prison, the Albuquerque Journal reported.

Ho’s note had said: “Caution Touch at your own risk or use gloves Ha-ha,” the report said.

Ho hugged her attorney and cried briefly after the verdict was read. The attorney said his client was never offered an opportunity to participate in the federal pre-trial diversion program and was never offered any plea but a felony.

Assistant U.S. Attorney Amy Sirignano said there was no misdemeanor plea that fit Ho’s conduct.

This guy deserved to be fired.  Lee, you know me, we met and hung out, and I practice law here.  Trust me, Iglesias has played the biggest victim of them all.  Yet, every attorney in town knows he was a terrible USA, and even his own staff hated his guts.

Bush should have come out and said this guy, for example, was fired for incompetence.  However, that is not how it is normally done.  This isn’t scandal, it’s the norm for a political job.

I urge you to re-think your stance on this.

Let me put it this way.  Were it not for this administration’s six-year record of lying, obfuscating, distorting, and general bullshitting I would probably be likely to give them the benefit of the doubt.  But eventually even the most partisan among us has to recognize that they’re being deceived.

Fair enough, Lee.  You know I love arguing here because you are pretty honest about your views and there is no sucking of anyone’s ass here.
